Kathmandu, Feb. 5 -- Departure from 'protracted peoples' war' to 'capitalist revolution' is the main theme of the ongoing convention of Nepal's ruling Maoists. But India too is high on the agenda.
The former rebels who viewed India as the number one enemy earlier are now divided on whether to continue that policy or adopt a softer approach towards the southern neighbour.
Reports say disagreements between chairman Pushpa Kamal Dahal'Prachanda' Prachanda and vice-chairman Narayan Kaji Shrestha on policy towards India delayed the start of the session.
As opposed to Prachanda and his aides who want the party to adopt a softer policy towards India, Shrestha and several others want the party to maintain a hard stance towards New Delhi.
"We are in government. We can't use provocative words (against neighbouring countries) in the chairman's political document," Kumar Poudel, a leader close to Prime Minister Baburam Bhattaraitold 'The Kathmandu Post'.
Shrestha had even threatened to present a separate political document if Prachanda's paper failed to include 'national independence' - which in Maoist parlance means freedom from New Delhi's interference.

As representatives at the General Convention start discussions on the political document presented by Chairman Pushpa Kamal Dahal, senior Maoist leaders are at loggerheads over the party’s position on ‘national independence,’ a terminology used to describe how the party views India.
In an interview with the Post, Party Vice-chairman Narayan Kaji Shrestha on Monday said the convention will amend Dahal’s document and give continuity to the party’s standing policy against ‘foreign intervention.’ Finance Minister and Standing Committee member Barsha Man Pun, however, termed Shrestha’s position as ‘blind nationalism’ that cannot safeguard national interests. In the next few days, Dahal will throw his weight around to find a meeting point between contending viewpoints on India, a task not always easy in a party where the rank and file was raised on strong anti-India rhetoric.Shrestha said he has given up plans to register a dissenting opinion after Dahal promised to incorporate concerns about national sovereignty in his political document.
“The chairman has requested me not to register a dissenting opinion and has assured me that a separate meeting of the party’s central body would be held within six months to determine the party’s position on India and review the controversial BIPPA agreement,” Shrestha said.
The Bilateral Investment Protection Agreement (Bippa) was signed by Prime Minister Baburam Bhattarai in New Delhi in 2011, but it has come under sharp criticism from a section of the party, including leaders of the breakaway CPN-Maoist.
Shrestha wants the chairman’s political document to clearly state that the Bhattarai-led government’s decision to sign the agreement with India was a wrong one. He has publicly criticised Prime Minister Bhattarai for “hastily” signing the deal despite Indian Prime Minister Manmohan Singh’s suggestions that it could be signed at a suitable time proposed by the Nepali side.
Shrestha has also expressed reservations over Dahal’s assessment that economic prosperity through generation of capital will strengthen the country, which will then strengthen national independence further. Dahal’s document has avoided terminologies like “Indian expansionism” and has remained silent on “Indian interference in Nepal’s affairs.”
“Our relationship with China is problem-free. However, we need to review our relationship with India on the basis of equality,” said Shrestha. “The party needs to focus on scrapping unequal treaties with India by proposing new ones and put an end to the presence of foreign (Indian) troops in Kalapani.”
Kalapani is a tri-junction in Darchula district in north-west Nepal and on the border of Pithoragarh district of India.
The foreign minister said Nepali leaders should stop engaging “officials of spy agencies of any foreign country” on its domestic political issues. “All such exchanges should only be with the political leadership of neighbouring countries,” he said.
Meanwhile, the party’s standing committee member Barsha Man Pun objected to Shrestha’s views, arguing that the foreign policy goals tend to shift with the changes in the party’s roles. “Now our party is in government, and as such, we cannot stick to the same old methods and rhetoric that we resorted to during the time of war on issues related to safeguarding national independence,” he told the Post.
Adopting a pragmatic approach, he argued: “We should be patient and change the nature of the movement to achieve our goals. We should be economically independent to safeguard national interests. Blind nationalism doesn’t work.”
Meanwhile, the Maoist party has said it will correct Dahal’s document that ‘wrongly’ mentions that Nepal’s international boundary will be ‘corrected’ through a national referendum.
The political document presented in the closed session on Sunday said the border dispute was an agenda of long-term importance and that it should be settled through a referendum after ‘extensive discussions’ among the people.
Experts have criticised the suggestion, saying that such a sensitive issue should be resolved through government-to-government negotiations with neighbouring countries, and not through a referendum. “We have a clear knowledge of Nepal’s international boundaries, hence there is no need to go for a referendum. Due correction will be made in the chairman’s document,” Shrestha said.

Nepal and India have agreed to work for the second cross-border line for the import and export of electricity from both the sides.
In the seventh meeting of the Nepal-India Joint Committee on Water Resources ( JCWR ) that concluded here on Friday, the two countries agreed to work for the line connecting Gorakhpur in India and a suitable location near Bardaghat in Nepal under the government-to-government cooperation. “The JCWR decided that the Nepalese side would prepare a concept paper along with the available technical details and send it to the Indian side for review,” the minutes of the meeting state.

In the meeting, Nepali officials proposed the transmission line as the implementation of the 400kv Dhalkebar-Mujaffarpur Cross Border Transmission Line, which was meant to be developed and operated on a commercial mode, is taking some time despite efforts from both the sides. The meeting also decided to take forward the Pancheshwar Multi Purpose Project, while participants reiterated the need for field work in the Rupaligad dam and powerhouse sites, which is pending for the last couple of years. However, India sought more time for the formation of the much-talked-about Pancheshwar Development Authority. On the Koshi High Dam project, the Nepali side brought up the issue of compensation for private land. The project has led to the erosion of 1,516 bighas of land during 1961-1964; 3,948 bighas in 1965-1968 and an additional 2,226 bighas later, which was jointly verified by both the sides.

“The compensation rates have been determined and the Nepalese side said the issue needs to be resolved with priority,” the minutes further said.

The Indian side agreed to take up the responsibility of maintaining the 15 km eastern Koshi embankment, upstream of Chakarghatti. It also agreed to speed up restoration work of the Birpur powerhouse, which was damaged in 2008, while agreeing to address grievances and requests that have come up on the Gandak project.

In the meeting, the Nepali side proposed the concept of ‘energy banking’ to be implemented in order to address seasonal disparities in demand and supply of electricity in the two countries at direct utility level or through various traders.

The Indian side agreed to extend financial and technical support in the West Rapti, Khando, Balan and Lakhandehi rivers, while the detailed project reports (DPR) of the projects, prepared by the Nepali side, have been handed over to the Indian side.

The meeting also talked holding the second meeting of the joint-ministerial level commission on water resources in Kathmandu, flood forecasting activities on rivers flowing from Nepal to India, the proposed Naumure hydro-power project, embankments on the Mechi river, review of activities of various bilateral committees, release of irrigation water for the Chandani-Dodhara area and the Tanakpur-Mahendranagar link road.

Energy Secretary Hari Ram Koirala and his Indian counterpart Dhurv Vijai Singh had led the respective sides in the talks.

At a time when the ruling Unified Communist Party of Nepal (Maoist) is pressing hard for the revival of the Constituent Assembly (CA) to promulgate a new constitution, former Chief Justices (CJs) of the country have told Prime Minister Baburam Bhattarai that such a process is not possible.
Six former CJs yesterday drew Bhattarai's attention to the fact that promulgating a constitution by reviving the CA would go against a decision of the Supreme Court.
The court had last November put a final six-month term cap on the CA.
"We told the prime minister that as the apex court verdict has placed a cap on the CA term and that the PM himself had dissolved the assembly and declared fresh elections, the CA cannot be revived to promulgate the constitution. Fresh polls are the only alternative," said Ram Prasad Shrestha, one of the six former CJs invited for consultations by Bhattarai.
The former CJs and the PM discussed the legal challenges to reviving the CA to promulgate a statute by incorporating agreed-upon issues and leaving the rest to the next elected body.
The other CJs invited were Hari Sharma, Om Bhakta Shrestha, Keshav Prasad Upadhyay, Anup Raj Sharma and Trailokya Pratap Rana.
However, Shrestha said that the CA could be revived as a legislature-parliament for a brief period to amend the Interim Constitution to hold fresh CA polls. He added that a parliament is necessary to conduct a hearing for appointments to constitutional bodies, including the Election Commission and the apex court.
"We advised the prime minister that the apex court verdict does not prevent the revival of the parliament to amend the constitution. But it has to be for a short period, a maximum of three months," said Shrestha, claiming that this would help remove constitutional difficulties.
Among the Articles of the Interim Constitution to be amended are Article 63 (7), which states that every Nepali citizen who attained the age of 18 by the end of December 15, 2006 will be entitled to vote during the CA elections.
The former CJs also told Bhattarai that the President cannot issue an order to amend the constitution nor can he promulgate ordinances to this end. They told the PM that even to revive the CA as a parliament, political consensus is a must and that the Cabinet needs to endorse the proposal and forward it to the head of state.

Kathmandu, Oct. 28 -- Any hope that the festive mood in Nepal could help end the ongoing political crisis seems unlikely for the time being with opposition parties rejecting a fresh move by ruling Maoists.
After a 'Dashain' hiatus of nearly 10 days, talks have resumed among the ruling parties and those in opposition, but there is no sign yet of resolving the impasse soon.
On Saturday, Nepali Congress and Communist Party of Nepal(Unified Marxist Leninist) rejected two proposals forwarded byUnified Communist Party of Nepal (Maoist) chairman Pushpa Kamal Dahal 'Prachanda'.
The Maoist chief had discussed the proposals in separate talks with NC president Sushil Koirala, CPN (UML) chairman Jhalanath Khanaland former Prime Minister and CPN (UML) leader Madhav Kumar Nepal.
Prachanda expressed his party's willingness to support a new government headed by NC if the latter agree on reviving the dissolved Constituent Assembly to promulgate the new constitution.
The other option suggested by him was for both NC and CPN (UML) to join the present Maoist-Madhesi coalition headed by Baburam Bhattarai if they stick to their demand of holding fresh polls.
"There's no question of discussing the fresh proposals till the present government leaves office and a new one takes charge," Khanal told reporters after the meeting with Prachanda.
Despite internal differences on whether the CA should be revived or fresh polls held, NC president Koirala also refused to entertain Prachanda's proposals.
Both NC and CPN (UML) have been opposing revival of CA and are demanding Bhattarai's resignation and formation of a unity government comprising all parties to hold fresh polls.
Prachanda who has been facing flak for his shifting stances on ending the present crisis has become active after the break in talks due to 'Dashain', the biggest and longest festival in Nepal.
On Thursday he had met President Ram Baran Yadav and submitted his proposals in writing.
Nepal is witnessing political and constitutional crisis since May following dissolution of the CA without promulgating a new constitution.

Women Break Silence About Sexual Harassment on Nepali Buses

   KATHMANDU, NEPAL Sapana Acharya, 18, a college student, moved more than 300 miles from her home district of Morang to get an education in Kathmandu, Nepals capital.
But the more difficult journey has been the daily bus ride to get to Ratna Rajya Laxmi College, a constituent campus of Tribhuvan University.
Its not because the buses are often crowded and uncomfortable. Rather, its the attitude and behavior of the male passengers. Acharya says they either push or inappropriately touch her usually intentionally during her 30- to 45-minute bus ride every day to and from school.
I am frustrated by being touched in my private parts in a crowded bus, she says.
The public transportation around Kathmandu is always crowded with throngs of people waiting to board already packed buses. The mobs are worst during peak hours, when working adults and students are traveling for their jobs and school. This allows more opportunity for perpetrators, Acharya says.
But she has no other option for getting to school.
I have to use the bus even if it is crowded, she says dejectedly. Otherwise, I will miss my classes.
But she refrains from reporting the sexual harassment because of the fear of what would happen if nobody believed her, she says.
Where do I go and report against such behavior? she asks. Is there any law against harassment? Even if there is one, how do I prove that I was harassed? There is no evidence.
Nepali women say they face constant sexual harassment on public buses, their main means of transportation to get to work and school. Double victimization deters them from reporting incidents, as society often blames the victims of sexual abuse here and evidence and witnesses are difficult to secure. Laws are in place to protect women from abuse, but reports and enforcement of penalties are rare.
There were more than 1.28 million public vehicles registered in Nepal during the 2010-2011 fiscal year, according to the Department of Transport Management. One million people use public transport daily in the70 of Nepal's 75 districts that are connected with a roadway, making this industry a major player in the Nepali economy.
Public buses are the main means of transportation for the majority of the population, especially women, children and people with disabilities, says Kathmandu traffic inspector Sitaram Hachhethu.
They are also the most common places for girls and women to suffer sexual harassment.
Manima Shubba, a homemaker living in central Kathmandu , stresses that women of all walks of life have faced abuse in public vehicles including her. The only difference is the number of times they have been victims.
Ganga Mishra, a 19-year-old student who attends the same college as Acharya, is one of those victims. Residing in the north of Kathmandu, she must take a 20-minute bus ride to get to school in the central part of Kathmandu. Like Acharya, she also faces constant sexual harassment on the bus.
As the bus started to move, the middle-aged guy moved towards me, Mishra says, recalling a particularly disturbing incidence. I didnt say anything when he bumped on me every time the driver hit the brake. I had to rebuke him when he moved his hand towards my chest.
Mishra says she felt lonely and humiliated when the perpetrator denied any wrongdoing. Instead of helping her, other travelers glared at her accusatorily. Even the females on the bus offered no help, she adds.
Mohan Mani Pokharel, an associate professor of educational psychology
at Tribhuvan University, says this amounts to sexual abuse.
Sexual abuse is not limited to sexual intercourse, he says. Touching the body parts, staring and even using obscene language is sexual abuse.
The perpetrator is often a middle-aged man who thinks he is secure in committing such a crime, Pokharel says. When confronted, he will put on a fatherly act, citing that he was just being protective.
Mishras experience left her wondering whether it is right to protest against harassment. But because of the other travelers response, she lost her confidence in speaking out against it.
Lawyer Shashi Adhikari, chairwoman of Legal Aid and Consultancy Centre, a nongovernmental organization that provides free legal services to women, says that womens low self-esteem and inability to speak in front of a crowd prevent them from seeking justice. Society blames the victim in cases of sexual abuse, so women fear stigma. Instead of speaking out, they keep quiet and endure the violence.
Parbati Thapa Magar, the deputy inspector general of Nepal Polices Midwestern Regional Police Office, says that women are the victims because they have lower self-esteem. She also cites the societal stigma attached to women who are abused for their reluctance to speak out.
The victims cannot utter things that the perpetrator[s] do to them, Magar says. The perpetrator should be ashamed of his behavior, not the victim who suffers.
Women, therefore, face double victimization when they have to fear the repercussions of speaking out against abuse, Magar says. Instead of confronting the perpetrators, most victims flee with self-shame.
Sexual abuse hurts girls and womens self-esteem and confidence, says Laxmi Pariyar, a former Constituent Assembly member and youth activist.
Pariyar, who has also been a victim of verbal sexual harassment on public transportation, says its difficult to report because of the lack of tangible evidence.
When I was traveling to my hometown, Udaypur, eastern part of Nepal, in an overnight bus, a few men said offensive things that I cannot repeat here to me, she says. I warned them, but they didnt back down. I ended up fighting with them and reported them to the police.
But Pariyar later withdrew her complaint because of difficulties in providing proof of the harassment.
Tara Maharjan, legal counselor for the National Women Commission, an independent commission established by the government for the promotion and protection of womens rights, confirms this challenge.
The commission receives complaints against domestic violence, but never have we received any on sexual abuse in public places, she says. It is so because of difficulty in proving the perpetrator guilty.
There is not a single written report filed under sexual abuse in public vehicles at the Midwestern Regional Police Office, Magar says.
The Interim Constitution of Nepal 2006 ensures the right of all citizens to freely travel around the country. Various rules and bylaws regulate the transportation sector.
Nepali law penalizes sexual abuse with three months in prison for the perpetrator and a fine of 25,000 rupees ($300) to compensate the victim, Maharjan says. But the reporting system is not victim-friendly, as its difficult to collect evidence and find witnesses to testify in court.
Due to all these reasons, the victims do not take legal action, Maharjan says.
Hachhethu says that the traffic police intervene if they witness sexual abuse even if there is no formal complaint.
I saw a bus staff trying to molest a girl while helping her board the bus, Hacchethu says. Although the girl didnt complain, I took him
in custody.
But police dont always uphold the penalties outlined by the law.
I left him after he signed a commitment saying he would not repeat such behavior, Hacchethu says.
For victims, he encourages them to report incidents.
Women do not show courage to complain against sexual abuse, Hachhethu says disappointedly.
Prahlad Karki, section officer in the Department of Transport Management, encourages girls and women to report sexual harassment.
We can intervene if the bus staff commit such crime, he says. But then the crime should be reported, and we have not received any complaints to date.
Pariyar asks police to be better enforce the law.
The guidelines of the Ministry of Labour and Transport should be strictly enforced with regard to the use of impolite language, touching the bodies of women unnecessarily while demanding the fares by the public transport conductors and pasting of obscene advertisements inside the vehicle, she says.
Mishra suggests stationing undercover policewomen on public buses to catch perpetrators.
The Ministry of Physical Planning, Works and Transport Management formed the Public Transport Code of Conduct in 2010 to regulate the transportation sector, Adhikari says. The code includes reserving seats for women, the elderly and the disabled.
But able-bodied men often disregard the law and occupy these seats, saysArjun Shrestha, abus driver in Kathmandu.
Society needs to address the culture of violence against women, as sexual harassment toward women is not limited to crowded buses and marketplaces, Magar says.

Nepali parties continued to battle on Wednesday over whether to go for fresh elections or revive the expired Constituent Assembly (CA), to promulgate a new constitution.
While the Maoists pushed for agreeing on contentious constitutional issues and CA reinstatement, opposition parties demanded Prime Minister Dr. Baburam Bhattarai’s resignation first, and remain divided on revival.
Speaking to reporters on his return from a visit to Europe, Maoist chairman Pushpa Kamal Dahal ‘Prachanda’ said, “I am confident that all parties will eventually resolve constitutional issues and agree to promulgate the statute through revival. We can take issues on which we still retain differences to the people during the next elections.”
Giving a timeline, Mr. Prachanda said it would be ‘best’ if they could come to an agreement before Vijaya Dashmi (October 24) but to work out everything, it may take mid-November.
Dr. Bhattarai is learnt to have reached out to second-rung leaders of the Nepali Congress (NC) and Communist Party of Nepal (Unified-Marxist-Leninist) to push for revival. Sources close to him told The Hindu that his key message is holding polls is ‘impossible’ and unless there is an agreement, ‘six decades of democratic achievements’ would be at risk.
On federalism, over which constitutional discussions broke down in May, Dr. Bhattarai has suggested two options. According to a former NC MP who met him in this regard, “Dr. Bhattarai said the constitution could commit there would be six to fourteen states in the federal set-up, with names and boundaries to be determined in the next Parliament. The second option could be stating there would be two provinces in the Tarai, excluding five districts in the east and western plains. Their fate could be decided in the future through referendum or parliament.”
In May, Madhesi parties and Janjati groups had opposed ‘postponing’ issues related to federalism for the future.
The former had also demanded that there be only two provinces across Tarai.
The opposition parties have rejected the proposal of revival. After a joint meeting of NC and UML, former Prime Minister Madhav Kumar Nepal was reported in the local media as saying, “We will not be confused by the Maoist proposal. There is no alternative to fresh elections.” He also said that president should think of how to appoint a new Prime Minister. UML General Secretary Ishwor Pokharel warned at a public program that seeking to revive the CA could be ‘contempt of court’, since the Supreme Court (SC) prohibited further extensions.
While NC leaders Sher Bahadur Deuba and Ram Chandra Poudel have supported revival, party president Sushil Koirala has spoken out for fresh elections.

Six years after the formal end of the civil war, Nepal’s “peace process” has concluded with the integration of a little over 1,450 former Maoist fighters into the Nepal Army (NA).
The cantonments where the former combatants of the Maoist People’s Liberation Army (PLA) resided have closed down, Maoist weapons are under state control, and the PLA has ceased to exist ending the state of “one country, two Armies”.

In the past few weeks, the final phase of the integration process saw 1,388 combatants who had opted for integration pass through the NA-conducted selection examinations. They would join at the solider level. Seventy five other former Maoist fighters have cleared the written exam to join the NA at the officer level, though final results for them have not yet been announced since medical tests and interviews are to be completed. Officers are to go through a nine-month training course, and soldiers would undergo a seven-month course — both sets will also have an additional three-month “bridge course”.

Over the past five years, there has been a gradual reduction in the number of combatants in the cantonments. About 32,000 individuals had initially registered in the camps in early 2007. But the United Nations Mission in Nepal (UNMIN) verified only 19,602 of those as combatants and disqualified over 4,000 persons for being under-age or joining the Maoist Army after the ceasefire began. The “disqualified” were discharged from the cantonments in early 2010.

In November 2011, a seven-point agreement was signed between the parties, which stipulated that a maximum of 6,500 former combatants could be integrated in a specially created general directorate under the NA. In the first phase of regrouping, over 7000 combatants opted to retire with cash packages while over 9,000 opted for integration.

But in subsequent rounds, this number steadily dipped and finally, around 1,600 combatants and 116 officer-level former fighters chose to go through selection tests.

In April 2012, the Nepal Army had also taken charge of the cantonments as well as containers that included over 3,000 Maoist weapons. The NA is now making arrangements to transport the containers to army centres from the cantonments, which have closed down.
Challenges

Minendra Rijal, a member of the Special Committee for the Supervision, Integration, and Rehabilitation of former combatants, said that the process was now complete, and highlighted the key challenge ahead. Speaking to The Hindu, he said, “It is now important that there be no relationship between the Maoist party and those former fighters who have joined the Army; they must see themselves like any other solider. At the same time, the Nepal Army too must not discriminate against those who have been integrated. That will be the yardstick for successful integration.”

There is some uncertainty about where the combatants would be accommodated in the Army structure, since a lot fewer combatants than expected will be getting integrated. The original strength of the proposed general directorate was 18,500 — with 6,500 former Maoists constituting 35 per cent of the force and the remaining 65 per cent personnel from the security forces. It was to have multiple responsibilities, and be headed by a Major-General.

“I don’t think there will be a general directorate now. There could be a directorate, which has limited responsibility, since its size will only be around 3,500 now,” says Deepak Prakash Bhatt, a member of the Special Committee Secretariat. The Maoist leadership has however insisted that a general directorate be formed in keeping with the agreement.

While there was an informal agreement that the senior-most rank to be given to the Maoists would be that of a colonel, sources say that going by years of service, several former Maoist commanders would be eligible only to rise up to a major. “Profession says major, let us see what politics determines,” said a key official involved closely with the process.

With over 15,000 trained and ideologically-influenced combatants opting to retire, there have been concerns about their future course of action. Among them, some have joined the radical Maoist splinter led by Mohan Vaidya ‘Kiran’, and are being organized into a semi-military structure. But most are, according to those who have closely worked in cantonments, returning to their families, setting up businesses and working with their old Maoist party.

Ending the uncertainty about the political roadmap, Nepal’s major political forces have agreed to go in for fresh elections for a Constituent Assembly (CA).
The previous CA failed to deliver a Constitution, owing to differences on state restructuring among political parties. Its term ended on May 27.

On Wednesday, the four major political forces — Unified Communist Party of Nepal (Maoist), Nepali Congress (NC), Communist Party of Nepal (Unified Marxist Leninist), and United Democratic Madhesi Front (UDMF) — discussed ways to resolve the political impasse. One option was to revive the CA, while the second was to hold elections. The revival of the CA remained contingent on a deal on federalism. Parties stuck to their stated positions on the names, numbers and boundaries of federal states. The Maoists and Madhesi parties stood for either 10 or 14 primarily identity-based states, as recommended by the CA committee and State Restructuring Commission concerned. The NC pushed for 11 states, which would have carved out the Tarai plains into five provinces, and the UML argued in favour of a seven-state model.

Emerging from the talks on Wednesday evening, UML chairman and former Prime Minister Jhalanath Khanal, said, “We are not in a situation to agree on contentious constitutional issues. So the possibility of reinstating the CA for a short while to promulgate the constitution is not there anymore. We have decided to go for fresh elections.”

While the NC had earlier backed polls for a new Parliament, party general secretary Krishna Prasad Sitaula, said they had agreed elections would be for a new CA. “Once the CA does its work and the constitution is promulgated, the same house can transform into a Parliament. Elections will take place under a national unity government.”

Speaking to The Hindu, Health Minister and Madhesi leader, Rajendra Mahato, said Wednesday’s in-principle agreement needs to be followed by a ‘package deal’. “While the election system will be a mix of both first-past-the-post and proportional representation like last time, we now need to decide on the number of seats, date of fresh polls, ways to remove the constitutional and legal difficulties in holding polls, and leadership and composition of the election government.”

The interim constitution did not envisage a second CA poll, and in the absence of a Parliament, the only way to amend election related laws in the statute is if President Ram Baran Yadav uses his power to ‘remove obstacles’ based on a political consensus. The leadership of a new unity government which would hold polls is also up for grabs. With Maoists and NC ruling out any chance of supporting the leadership of the other party, there is speculation that a neutral figure — a former Chief Justice or civil society leader — may lead the election government.

The Maoist-led government, along with its Madhesi partners, had announced fresh polls to a CA on May 27 itself. But terming it as an ‘unconstitutional’ and ‘unilateral’ decision, the opposition parties had refused to accept the decision. In recent weeks however, several actors — including President Yadav, second-rung leaders of political parties, media and the international community — had nudged parties towards elections.

Nepal and China have sealed the deal on the West Seti Hydropower Project in West Nepal with the two sides signing a fresh Memorandum of Understanding last month.
The development is likely to cause unease in New Delhi that has struggled with little progress in its own hydropower projects in Nepal, coupled with Nepal’s growing coziness with China.

The US $1.6 billion project — the biggest foreign investment project in Nepal — was earlier designed to supply electricity to India, but it will now be meeting Nepal’s own domestic requirements with the surplus being sold to China.

Nepal, which has been facing a severe power crisis, is estimated to have 43,000MW hydropower generation capacity, but the actual production is a woeful 650 MW.

India has dominated the hydropower sector in Nepal so far, but several of its projects have been stalled because of various reasons such as protests from Maoists against awarding deals to foreign companies. Projects like the Upper Karnali and Arun III have not showed any progress despite MoUs having been signed years ago. Last year, a GMR Power-led consortium’s camp site office in Dailekh district was reportedly burnt down.

In a recent letter to the prime minister’s office and the ministry of external affairs, the Research and Analysis Wing said, “The government of Nepal has granted permission to China Three Gorges Corporation (CTGC) to proceed on the 750 MW West Seti Hydropower Project on the Seti river in Dadeldhura district.

“The Investment Board of Nepal and the CWE Investment Company of China (sub group of CTGC looking after overseas operations) signed (August 27, 2012) a revised Memorandum of Understanding for construction of the WSHP.”

The communication states that the Nepal government took the decision following the visit of a three-member Nepalese delegation led by energy secretary Hari Ram Koirala to China on August 7, 2012 to negotiate issues related to investment and revision of the MoU signed earlier.

Estimated to cost about Nepalese Rs 180 billion, work on the project is scheduled to start this year and will be completed by 2020, the letter says. “The WSHP initially designed to export electricity to India, is now aimed at meeting the growing energy demand of Nepal,” the communication dated August 30 states.

The project was first awarded to an Australian company — Snowy Mountain Engineering Corporation — in 1997. On completion, the project was supposed to sell electricity to India. But it never took off. Last year, the Nepal government scrapped the contract and started discussions with China.

On February 29 this year, CTGC signed an MoU with the Nepal government for construction of WSHP. CTGC was supposed to hold 75 percent stake in the project and the Nepal Electricity Authority (NEA) 25 percent. The CTGC had also agreed to provide 2-5 per cent shares to the local investors from its stake and help the NEA to secure a soft term loan from the Exim Bank of China for the project.

The project had then run into rough weather over allegations of preferential treatment to China by not allowing international bidding for the project. Nepal’s Natural Resources and Means Committee (NRMC) of the Constituent Assembly, since dissolved, had, raised objections over the terms of the MoU. This forced the Nepalese government to put the project on hold. China had then reportedly threatened to pull out of the project if the Nepalese government did not take a decision soon.

“As per the revised MoU, the CWE will now provide 10 per cent stake to the local investors and agreed to make the project multipurpose by including irrigation, fishery and water transportation components in the project, in line with the recommendations made by the NRMC. About 150 MW of electricity would be allocated for the industrial development of local area.”

“The Chinese company has also reportedly agreed to help generate funds for construction of the transmission line simultaneously so that the electricity generated could be linked to the national grid without delay. China Exim bank and China Development bank have already expressed interest to invest in the project and provide additional funds for construction of the transmission line."

नेपाली राजनीति में शुरु से लेकर आज तक भार त की भूमिका के सर्न्दर्भ में अगर  कहा जाए कि ‘कुछ बात है कि हस् ती मिटती नहीं हमारी’ तो अतिशयोक्ति नहीं होगी । यह कटु सत्य है कि भले ही हम भार तीय राजदूत पर  जूता उछालें या फिर  वीरगंज के कन्सुलर  को बदनाम कर ने की कोशिश कर , नेपाली राजनीति में भार तीय वजूद को नकार  नहीं सकते । अभी हाल ही में प्रकाशित श्याम शर ण जी के लेख से कुछ बातें सामने आई हैं । पहली महत्त्वपर्ण्ा बात नेपाली सेना में नियुक्ति, पदोन्नोति के सम्बन्ध में उन्होंने अपनी भूमिका को स् वीकार  किया है । वास् तव में नेपाल-भार त सम्बन्ध में हमेशा नेपाल जैसे आर्थिक महत्त्व की बातों को तर जीह देता है- वैसे ही भार त सुर क्षात्मक बातों को । यही कार ण है कि सेना और  सुर क्षा के मामले में भार त चुप नहीं बैठ सकता । दूसरी घटना नेपाल के एक वरि ष्ट पत्रकार  से जुडी है- जिस में बिना सच्चाई जाने ही उसने भार त विर ोधी समाचारों का संप्रेषण किया, जिसके लिए उसने बाद में माफी भी मांगी । वास् तविकता तो यही है कि हमारे यहाँ राष्ट्रीय हित पर  व्यक्तिगत हित हाबी है । किसी भी देश की विदेश नीति र ाष्ट्रीय हित पर  आधारि त होती है । लेकिन हमारे यहाँ राष्ट्र की चिन्ता किसे है । हमने आज तक नहीं देखा है कि किसी र ाष्ट्रिय मुद्दे पर  एकजूट होकर  हम भार त के समक्ष उपस्िथत हों । यहाँ तो किसी की कर्ुर्सर्ीीीन जाती है तो वह भार त विरोधी बन जाता है । किसी नेता के बच्चे को अगर  मेडिकल या इन्जीनीयरिंग में दाखिला नहीं मिलता हैं तो वह भारत के विरोध में आग उगलने लगता है । मिडिÞया का भी कमोबेश यही हाल है । जब तक किसी पत्रिका या चैनल को भार तीय र ाजदूतावास से प्रत्यक्ष अप्रत्यक्ष आर्थिक सहायता मिलती र ही है, तब तक तो ठीक, नहीं तो वह भी भार त विर ोधी बन जाता है ।
अभी हाल ही में कुछ दिनों पहले मार्टिन चौतार ी द्वार ा आयोजित सेमिनार  में कार्यपत्र प्रस् तुत कर ने मैं काठमांडू गया था । एक सम्यवादी नेता उस सेमिनार  में भार त विर ोधी तेवर  लिए नेपाल-भार त सम्बन्ध पर  टिप्पणी कर ते हुए एक लम्बी कहानी सुना गए, जिसका सार  यही था कि कैसे एक व्यक्ति किसी बकर े को पाल पोस कर , खिलापिला कर  बडÞा बनाता है और  जब उसका मन कर ता है उसे मार  कर  खा जाता है । मैं कहता हूँ कि बकर ा की यह दर्ुदशा इसलिए है क्योंकि वह पर जीवी है । लेकिन सवाल यह है कि हम पर जीवी क्यों या कब तक बने र हें । हम क्यों नहीं स् वावलम्बी अब तब बन सके – विगत से लेकर  आज तक हमें क्यों किसी की मदद या सहार े की जरुर त होती है – विभिन्न र ाजनीतिक दलों और  माओवादियों के बीच अपने देश में भी तो कई बार  बार्ताएँ हर्ुइ थी । देश में यह बार्ता क्यों सफल नहीं हर्ुइ – क्यों दिल्ली में ही यह बार्ता सफल होती है -
नेपाल-भार त बीच समझदार ी-असमझदार ी का एक प्रमुख कार ण नदी जल विवाद भी र हा है । भार त द्वार ा कोशी नदी पर  बाँध बनाए जाने से नेपाल में असंतुष्टी जताई गई । ऐसा आकलन किया गया कि बाँध के कार ण नेपाल की जमीन का एक बडÞा हिस् सा पानी में डूब जाएगा । नेपाल सर कार  को इस बाँध से उत्पन्न होने वाली बिजली का लाभ मिलना था, लेकिन इस बात की अनदेखी कर  दी गई । बाँध से जुडेÞ किसी भी प्रकार  के हर्जाने का भुगतान भी भार त सर कार  को ही कर ना था । कुछ दिनों बाद जब महाकाली नदी पर  पञ्चेश्वर  नामक स् थान में एक नए बाँध के निर्माण की परि योजना को मञ्जूर ी मिली तो फिर  से विवाद उत्पन्न हुआ और  भार त द्वार ा नेपाली भूभाग को कब्जा में लिए जाने का आर ोप लगाया गया ।
नेपाल में भार त विर ोधी तत्वों की चहलकदमी के कार ण भी भार त और  नेपाल के बीच मनमुटाव हुआ है । इसी भूमिका उपभोग भार त विर ोधी तत्व कर ते र हे हैं । नेपाल पर्यटकों का एक प्रमुख आकर्षा केन्द्र है और  इसीलिए भार त विर ोधी तत्व यहाँ आसानी से पर्यटकों का जामा ओढÞकर  चले आते हैं । जब जनवर ी २००० में काठमांडू से एक भार तीय विमान का अपहर ण हो गया, तब इस बात की पुष्टी हो गई कि कैसे इस षडÞयन्त्र के तार  काठमांडू से कांधार  और  काबुल तक जुडेÞ हुए हैं । यह बात अवश्य है कि नेपाल सर कार  इन भार त विर ोधी तत्वों की मदत तो नहीं कर ता है लेकिन उस पर  पूर ी तर ह से अंकुश लगाने में भी सक्षम नहीं है ।
जब शाही महल के कत्लेआम में तत्कालीन र ाजा वीर ेन्द्र सपरि वार  मौत के घाट उतार  दिए गए और  ज्ञानेन्द्र ने नेपाल की सत्ता पर  कब्जा जमा लिया, तब उस समय में भी अचानक भार त-नेपाल सम्बंधों में तनाव बढÞ गया था । तत्कालीन शासक ज्ञानेन्द्र भार त और  नेपाल के जनतान्त्रिकीकर ण दोनों ही के विर ोधी थे । नेपाल में माओवादी व्रि्रोह के कार ण भी नेपाल और  भार त के सम्बन्ध तनावपर्ूण्ा र हे हैं । माओवादियों समेत नेपाल में जनतन्त्र के र्समर्थकों को लग र हा था कि र ाजशाही को भार त सर कार  द्वार ा र्समर्थन दिया जा र हा है । जनआन्दोलन की तीव्रता के समय डाँ. कर्ण्र्ाासंह का काठमांडू आकर  तत्कालीन शासक ज्ञानेन्द्र से मुलाकात के कार ण यह शंका और  बढÞ गई । दूसर ी ओर  र ाजवंश को लग र हा था कि पर्दे के पीछे विपक्षी दलों के माध्यम से र ाजमहल के विर ोधियों को भार त सहायता और  संर क्षण प्रदान कर ता र हता है । उधर  माओवादियों को लग र हा था कि भार त द्वार ा नेपाल को उपलब्ध कर ाए गए सैनिक साज समानों का उपभोग उन्हीं के विरुद्ध किया जा र हा है ।
लेकिन अब समय परिर् वतन हो चुका है । देश में गणतन्त्र की स् थापना हो गई है और  एक समय के हिंसक नेपाली माओवादी न सिर्फजिम्मेवार  संसदीय र ाजनेता की भूमिका निभा र हे हैं बल्कि सत्ता भी उन्हीं के हाथों में है । माओवादी सांसदों पर  अन्य दलों के सांसदों की तुलना में भ्रष्टाचार  निकम्मेपन का कम आर ोप लगा है । यह भी सत्य है कि नेपाली माओवादी हिंसा और  तत्कालीन शाही सर कार  भी हिंसा को एक ही तर ाजू के पलडÞो में नहीं तौला जा सकता । यह बात अलग है कि माओवादियों के एक गुट का तेवर  अभी भी भार त विर ोधी बना हुआ है । यह सच है कि भार त सर कार  ने संवैधानिक र ाजतन्त्र के नाम पर  निर ंकुश र ाजशाही को प्रत्यक्ष और  पर ोक्ष र्समर्थन दिया है, उस का प्रहार  माओवादियों और  जनतन्त्रवादियों ने ही झेला है । नेपाली सेना के दिए गए भार तीय हथियार  किसी बाहर ी शत्रु के विरुद्ध नहीं, अपने ही नौजवानों को कुचलने के लिए इस् तेमाल हुए है । यह जरुर  है कि भार त का र ाष्ट्रहित नेपालियों पर  थोपना उचित नहीं होगा । भार त की भलाई इसी में है कि नेपाल में स् िथर ता और  शान्ति बहाल होने के बाद, आर्थिक विकास गति पकडÞे । जैसे जैसे समाज में व्याप्त दर्दनाक विषमता कम होगी, नेपाल-भार त सम्बन्ध भी खूद बखूद सामान्य होता चला जाएगा । खुली सीमा के कार ण भार त को अपनी सुर क्षा व्यवस् था के लिए चिन्तित होना स् वाभाविक है लेकिन यह भी सच है कि बिना स् थानीय लोगों की मदत से कोई भी आतंकवादी गतिविधि सम्भव नहीं होती । अतः हर  विस् फोट को विदेशी साजिश कर ार  देकर  सर कार  जो अपना पल्ला झाडÞ लेती है, वह भी उचित नहीं है । केन्द्र सर कार  और  र ाज्यों की सर कार ों को भी अपनी सुर क्षा व्यवस् था को चुस् त दुरुस् त बनाना होगा । वैसे भी मुझे लगता है कि नेपाल के किसी भी संघ या संगठन की इतनी ताकत या प्रभाव नहीं है कि वह भार त के उग्रवादियों को प्रभावित या मार्गदर्शन कर  सके ।

सन् २००० की तैयारी में जुटी पूरी दुनियां को सन्न करने वाली आतंकवादी घटना के बीज नेपाल में ही बोए गइ थे । नए दशक की शुरूआत से ठीक पहले पाक आतंकवादियों ने

काठमाण्डू से दिल्ली के लिए उडान भरी आइसी-८१४ का अपहरण कर लिया था । इस आतंकी घटना को अंजाम देने के लिए देश का एक मात्र अन्तरष्ट्रीय विमानस्थल की सुरक्षा व्यवस्था को धत्ता बताते हुए आतंकवादियों ने आराम से हथियार सहित विमान में प्रवेश किया था । बाद में जांच से मालूम हुआ कि आतंकवादियों ने इस घटना को अंजाम देने के लिए पूरे विमानस्थल की सुरक्षा व्यवस्था को ही खरद लिया था । उस विमान अपहरणकाण्ड का असर नेपाल पर तो कोई खास नहीं पडÞा मगर विमानस्थल की सुरक्षा व्यवस्था को थोडी कडÞी कर दी गई । लेकिन नेपाली सुरक्षा व्यवस् था की विश्वनीयता पर सवाल खड हो गए ।
इस घटना के ठीक एक साल बाद यानी सन् २००१ में भारतीय संसद पर आतंकियों ने हमला किया था । इस हमले के दौरान आतंकियों की बातचीत नेपाल में रहे एक शख्स के साथ हो रही थी । इस हमले का असर नेपाल पर कुछ नहीं हुआ । लेकिन भारतीय खुफिया एजेन्सी और सुरक्षाबलों की नजर में यह बात साफ हो गई कि पाक आतंकवादी नेपाल को सेफ लैण्ड के रूप में प्रयोग कर रहे हैं और नेपाल में ही बैठक कर भारत में कई आतंकी घटना को अंजाम देते हैं ।
संसद पर हमले और मुर्म्बई में हुए आतंकवादी हमले के बीच भारत के कई शहरों पर आतंकी हमले, सीरियल ब्लाष्ट की घटना को अंजाम दिया जाता रहा और हर हमले के तार किसी ना किसी रूप में नेपाल के साथ जुडे र हते थे । चाहे वह दिल्ली में हुए सीरि यल ब्लाष्ट की घटना हो या फिर जयपुर अहमदाबाद, पूणे या फिर कहीं और, हर आतंकी घटना में नेपाल की धरती का किसी ना किसी रूप में प्रयोग होने की बात सामने आती रही है ।
२६-११ को मुर्म्बई में हुए आतंकी हमलों में शुरू में तो नेपाल की किसी भी प्रकार की भूमिका सामने नहीं आई लेकिन इस हमले के ४ साल बाद अब तक के सबसे बडÞे आतंकी हमले का एक मास्टरमाईण्ड अबु जिंदाल पकडा गया तो मुर्म्बई हमले में भी नेपाल की भूमि का प्रयोग होने की बात स्पष्ट हो गई । इन सब घटनाओं से एक बात तो साफ है कि आतंकवादियों ने नेपाल की धरती का प्रयोग कर भारत में कई आतंकी घटनाओं को अंजाम दिया और उन घटनाओं में अब तक हजारों की संख्या में निर्दाेष लोग मारे जा चुके हैं । इन आतंकी घटनाओं का नेपाल पर अब तक सीधा असर नहीं पडने से ना तो यहां का सरकार और ना ही यहां की खुफिया विभाग या सुरक्षा बल और ना ही गृह मंत्रालय इस बात को लेकर  गम्भीर दिखाई देता है कि आतंक के पालन पोषण का असर  अप्रत्यक्ष रूप से नेपाल पर पडÞता ही है । आतंक से उठने वाली चिंगाी कभी भी हमार  घर को भी जला सकती है । आतंक से उठी आग की लपटों में हाथ सेंकने पर कभी ना कभी हमार ा भी हाथ जल सकता है ।
वैसे तो विश्व के ज्यादातर  हिस् सों में इन दिनों अशांति व्याप्त है । सभी महाद्वीपों में कहीं न कहीं आतंककारि यों ने सामान्य लोगों का जीना दूभर कर दिया है । नेपाल इस मामले में खुशनसीब है कि अब तक उसे इस भयानक त्रासदी का सामना नहीं कर ना पडा है । लेकिन इसका मतलब यह नहीं है कि जब तक हिंसा नहीं फैलती, जब तक धमाके नहीं होते, जब तक सामुहिक त्रासदी नहीं होती तब तक आतंक को हम पहचाने ही नहीं या फिर  जान बूझ कर  उससे अंजान बने र हे । मुश्किल यह है कि जब तक हिंसा नहीं फैलती, हम आतंकी चेहर ों को पहचान नहीं पाते । भार त सहित दुनियां के कई हिस् सों में होने वाली आतंकी घटनाओं पर  तो हमार ी नजर  र हती है पर  अपने ही देश में पनप र हे ‘खामोश आतंकवाद’ की तर फ तो हमार ा ध्यान ही नहीं है ।
भार त में होने वाले हर  आतंक की घटना का किसी ना किसी रूप में नेपाल से जुडेÞ होना इस बात का पर्याय है कि हमार ा देश आतंक की काली साया से पर े नहीं है । नेपाल को आतंकियों ने अपना सेफलैण्ड बना लिया है । खुली सीमा, लचर  सुर क्षा व्यवस् था, अस् िथर  आन्तरि क र ाजनीति और  गैर  जिम्मेदार  सर कार ी रवैया के कार ण नेपाल में तेजी से खामोश आतंकवाद ने अपना दबदबा कायम कर  लिया है । इस बात की पुष्टि विकिलिक्स के द्वार ा र्सार्वजनिक किए गए अमेरि की दस् तावेज में भी किया गया है जिसको विस् तार  से हिमालिनी के पिछले वर्षजनवर ी के अंक में प्रकाशित किया गया था ।
भार त के मुर्म्बई में हुए २६-११ के हमले का मास् टर माईण्ड अबु जिंदाल उर्फअबु हमजा की गिर फ्तार ी के बाद जो तथ्य सामने आए हैं वह वाकई में हैर ान और  पर ेशान कर ने वाले हैं । पूछताछ के दौर ान अबु जिंदाल ने जो तथ्य भार तीय सुर क्षा एजेन्सियों के सामने बयान किया है उससे नेपाली सुर क्षा अंगों की नींद चाहे हर ाम ना हर्ुइ हो लेकिन यहां के बुद्धिजीवी वर्ग और  सचेत नागरि कों की नींद जरूर  हर ाम हो गई है । यदि समय र हते यहां की सर कार  और  सुर क्षा बल सचेत नहीं हुए तो वह दिन दूर  नहीं जब आतंक की धधकती ज्वाला नेपाल में भी दिखाई देगी और  उसकी लपटों में हम सभी को जलना पडेगा ।

पाठ उस समय सीखा था जब लश्कर-ए-तैयबा के आतंकवादी मोहम्मद असलम उर्फअसलम कश्मीरी ने नेपाल में २००४ में उसके लिए हथियार प्रशिक्षण की व्यवस्था की । तीस वषर्ीय जिंदाल ने जांच कर रहे अधिकारियों को बताया कि उसे राजौरी, जम्मू-कश्मीर के हसप्लोते निवासी असलम कश्मीरी ने नेपाल के मदरसे में ‘जेहाद’ का पाठ पढाया था ।
भार त के गृह मंत्रालय को सौंपी गई उसकी पूछताछ रिपोर्ट के अनुसार जबीउद्दीन उर्फअबू जिंदाल ने कहा कि पुंछ क्षेत्र के जरिए सीमा पार कराने के लिए महाराष्ट्र और गुजरात के चार युवक २००४ में असलम कश्मीरी को सौंपे गए थे, लेकिन सेना ने उन्हें मार  गिर ाया, जिससे कश्मीरी की भूमिका को लेकर  संदेह पैदा हो गया । असलम कश्मीर ी ने जबीउद्दीन और फैयाज कागजी से पुनः सर्ंपर्क किया और उनसे हथियार प्रशिक्षण के लिए अपने साथ नेपाल चलने को कहा, लेकिन चार युवकों के मारे जाने की घटना से यह संदेह पैदा हो गया था कि हो सकता है कि असलम कश्मीर ी सेना के लिए काम कर  र हा हो ।
जबीउद्दीन ने जांचकर्ताओं को बताया कि इस पर  असलम ने अपने बार े में यह साबित कर ने के लिए कि वह आतंकी समूह के लिए ही काम कर ता है, उनकी बात फोन पर  पाकिस्तान में लश्कर के शर्ीष्ा आतंकियों से करर् ाई । इसके बाद बीडÞ महार ाष्ट्र निवासी जबीउद्दीन चार  लोगों के साथ नेपाल र वाना हुआ जहां उसे हथियार  चलाने एवं विष्फोट में प्रयोग किए जाने वाले आर्ईईडी बनाने का प्रशिक्षण दिया गया ।
अपनी वापसी के बाद जबीउद्दीन ने और  अधिक युवकों की विचार धार ा को बदलने का काम शुरू कर  दिया, ताकि आतंकी नेर्टवर्क का विस् तार  किया जा सके । उन्नीस फर वर ी २००६ को अहमदाबाद र ेलवे स् टेशन पर  हुए विस् फोट की जांच के दौर ान पता चला कि नेपाल से प्रशिक्षण लेकर  आए आतंकी ही इन गतिविधियों में लिप्त हैं ।
१९ फर वर ी २००६ को तडÞके १ बजकर  ४३ मिनट पर  अहमदाबाद स् टेशन पर  जबर दस् त विस् फोट हुआ था । इस में २५ लोग घायल हो गए थे । यह सौभाग्य की बात थी कि उस दिन र विवार  होने के कार ण स् टेशन पर  ज्यादा लोग नहीं थे । पूछताछ में जबीउद्दीन ने दावा किया कि आर्ईईडी का टाइमर  सेट कर ने में थोडÞी गलती हो गई थी, जिससे धमाका समय से पहले ही हो गया । बम दो पहर  बाद फटना था, जब स् टेशन पर  ज्यादा भीडÞ होती है ।
जांच में पता चला कि इस मामले में बम बनाने वाला वही जबीउद्दीन था जिसने नेपाल में आतंक की चल र ही पाठशाला से प्रशिक्षण लेकर  लौटा था । बाद में इसकी पुष्टि असलम कश्मीर ी ने भी कर  दी, जिसे केद्रीय सुर क्षा एजेंसियों से मिली गुप्त सूचना के बाद २५ अगस् त २००९ को दिल्ली र ेलवे स् टेशन से महार ाष्ट्र जाते समय गिर फ्तार  किया गया था ।
असलम कश्मीर ी जबीउद्दीन के सहयोग से महार ाष्ट्र एवं गुजर ात में हथियार  एवं गोला-बारूद की आपर्ूर्ति भी कर ता था जो वह नेपाल की खुली सीमाओं का फायदा उठाकर  भार त में आसानी से ले आता था । एक बार  तो भार तीय खुफिया एजेंसियों ने समय पर  नासिक-और ंगाबाद र ाजमार्ग पर  ४३ किलोग्राम आर डीएक्स, १६ एके ४७ असाल्ट र ाइफलें, ३२०० गोलियां और  ५० हथगोले बर ामद कर ने में सफलता पाई । ये सभी हथियार  और  गोला बारूद नेपाल के र ास् ते ही लाए गए थे । हालांकि जबीउद्दीन और  असलम कश्मीर ी अंधेर े का लाभ उठाकर  चकमा देकर  भागने में सफल हो गए ।
असलम कश्मीर ी को लश्कर  का कट्टर  आतंकवादी माना जाता है, जो अपने आतंकी समूह के जिला कमांडर  हुफैजा शाह के मार े जाने के बाद प्रसिद्ध होना चाहता था । उत्तर प्रदेश से अर बी भाषा में स् नातकोत्तर  उपाधि र खने वाला असलम और ंगाबाद में हथियार  जब्त होने के बाद २००६ से घर  से लापता हो गया था और  तीन सालों तक वह नेपाल में ही छिपा र हा । दिल्ली में उसकी गिर फ्तार ी तक उसे खूंखार  आतंकवादी माना जाता था ।
अबु जिंदाल ने पुछताछ में एक और  चौंकाने वाली बात बताई । उसने नेपाल में आतंक की पाठशाला चलाने वाले अपने आकाओं के वो मोबायल नम्बर  भी बताए जिस पर  सभी आतंकी घटना को अंजाम देने के लिए बातचीत की जाती थी । जिंदाल ने आतंकवादियों के जो नम्बर  भार तीय खुफिया एजेन्सी को बताई वह ९७७-९८१८६२७५७८, ९७७-९८१३२८५५७३ और  ९७७-९८५५९२२२११ है । यह तीनों नंबर  नेपाल के हैं, जिसने लश्कर  और  नेपाल के कनेक्शन को भी उजागर  कर  दिया है । जी हां इन्हीं नंबर ों के माध्यम से लश्कर  के आका नेपाल में आतंक की नर्सर ी चलाते हैं । जिंदाल ने यह भी बताया है कि नेपाल ट्रेनिंग सेंटर  की जिम्मेदार ी ताहिर  उर्फचौधर ी को सौंपी गई है । जिंदाल ने इस बात का भी खुलासा किया है कि पाकिस् तान से आने वाले आतंकवादियों को नेपाल में ही आसानी से फर्जी पाकिस् तानी और  नेपाली पासपोर्ट बनवा दिया जाता है । ताकि समय समय पर  उसका प्रयोग किया जा सके ।
आतंक फैलाने का रास्ता बनता नेपाल-बिहार की खुली सीमा
नेपाल सीमा से लगा मधुबनी अपनी बेहतरीन साडियों और  पेंटिंग्स के लिए मशहूर  है, लेकिन अब यह आतंकियों के लिए दबे पांव भार त में घुसने का सुर क्षित रास् ता बन र हा है । नेपाल बिहार  सीमा क्षेत्र का मधुबनी जिला आतंकवादियों के लिए भर्ती के नए केंद्र और  छिपने के अड्डे के तौर  पर  भी उभर ा है । २००६ से, पुलिस अकेले मधुबनी से आतंकवादियों के छह खुंखार  एजेंटों को गिर फ्तार  कर  चुकी है ।
२०११ नवंबर  के आखिर  से लेकर  दिसंबर  की शुरुआत तक दो सप्ताह तक चले एक आँपरेशन में दिल्ली पुलिस ने यहां से इंडियन मुजाहिदीन -आइएम) के तीन और  संदिग्ध कारि ंदों को पकडÞा है । आर ोप है कि ये लोग १३ सदस् यों के उस आइएम माँड्यूल के हिस् से हैं, जिसने फर वरी २०१० में पूणे की जर्मन बेकरी और  अप्रैल २०१० में बंगलुरू के चिन्नास् वामी स् टेडियम में हुए विस् फोटों और  सितंबर  २०१० में जामा मस् िजद में हर्ुइ गोलीबार ी की साजिश र ची और  उसे अंजाम दिया । ऐसा माना जाता है कि इस माँड्यूल के लीडर  रि याज भटकल और  इकबाल भटकल हैं । इन्हीं दोनों भाइयों ने इंडियन मुजाहिद्दीन को खडÞा किया था और  दोनों फर ार  हैं । उन्होंने ही इन हमलों की साजिश र ची और  स् थानीय लोगों की मदद से उसे अंजाम दिया था । जर्मन बेकर ी में हुए धमाकों में १७ लोगों की जान गई थी और  बंगलुरू में स् टेडियम के बाहर  हुए विस् फोट में १५ लोग घायल हो गए थे । १९ सितंबर  को, दिल्ली में काँमनवेल्थ खेलों के शुरू होने से ठीक पहले जामा मस् िजद पर  हर्ुइ गोलीबार ी में दो ताइवानी पर्यटक घायल हुए थे ।
४१ लाख से ज्यादा की जनसंख्या वाला नेपाली सीमावर्ती मधुबनी जिला ‘एक और  आजमगढÞ’ होने की बदनामी झेल र हा है । पर्ूर्वी उत्तर  प्रदेश के आजमगढÞ जिले ने कई आतंकवादी हमलों के लिए जिम्मेदार  इंडियन मुजाहिदीन के कम-से-कम १३ कारि ंदे भेजे थे । इन हमलों में दिल्ली में २००८ में हुए सिलसिलेवार  धमाके भी शामिल थे जिनमें दो दर्जन से ज्यादा लोग मार े गए थे । दिल्ली पुलिस ने ६ दिसंबर  को नेपाली सीमा से सटे एक गांव से फारूक उर्फनवाब उर्फआफताब आलम को कथित तौर  पर  चिन्नास् वामी स् टेडियम में बम र खने के आर ोप में गिर फ्तार  किया था । फारूक, जो दुनिया को दिखाने के लिए किर ाने की छोटी-सी दूकान चलाता था, दिल्ली पुलिस की गिर फ्तार  में आया आइएम का कथित सातवां कारि ंदा है ।
२२ नवंबर  को दिल्ली के आनंद विहार  बस अड्डे से दिल्ली पुलिस ने इंडियन मुजाहिदीन के पहले कारि ंदे कतील सिद्दीकी को गिर फ्तार  किया । काफी दिनों तक नेपाल बिहार  की सीमावर्ती क्षेत्रों में र हने के बाद वह दिल्ली गया ही था कि उसकी गिर फ्तार ी हो गई । उसके बाद के घटनाक्रम में ये सार ी गिर फ्तारि यां एक के बाद एक ताबडÞतोडÞ तेजी से होती गईं । बिहार  पुलिस के साथ तालमेल से काम कर  र ही दिल्ली पुलिस ने २४ नवंबर  को २१ साल के छात्र और  मजहबी तालीम देने वाले गयूर  अहमद और  एक २८ साल के पाकिस् तानी नागरि क मोहम्मद अजमल उर्फशोएब को नेपाल के सीमावर्ती मधुबनी से सटे अलग-अलग इलाकों से दबोच लिया गया था । मधुबनी में सकर ी के पछिया टोला के एक गर ीब, मगर  प्रतिष्ठित परि वार  के गयूर  की गिर फ्तार ी से स् थानीय मुसलमान नार ाज हो गए । वे उसे बेकसूर  मानते हैं । अजमल ऊनी कपडÞों का दूकानदार  बन कर  र हता था और  उसने सकर ी से १५ किमी दूर  सिग्निया चौक पर  इसी साल सितंबर  में कमर ा किर ाए पर  लिया था ।
कमर ा लेने के बाद दो महीने के भीतर  ही उसकी मौजूदगी सबकी नजर  में आ गई थी । उसके हैर ान-पर ेशान मकान मालिक मोहम्मद नासिर  का दावा है कि उसकी बूढÞी मां ने विश्वास के आधार  पर  उसे कमर ा किर ाए पर  दे दिया था । नासिर  का कहना है, ‘वह सिर्फर ात में घर  लौटता था । हमार ी उससे बहुत कम मुलाकात हर्ुइ । कभी-कभार  अनजान लोग उससे मिलने आते थे । पडÞोसियों से उसने सिर्फएक बार  तब बात की थी, जबर् इद-उल-जुहा पर  उसने एक बकर ा कर्ुबान किया था ।’ अजमल और  गयूर  इंडियन मुजाहिदीन के उन छह संदिग्धों में से हैं, जिन्हें ५ दिसंबर  को १० दिन के लिए दिल्ली पुलिस की हिर ासत में सौंपा गया है । इन पर  जामा मस् िजद गोलीबार ी और  पुणे तथा बंगलुरू सहित विभिन्न आतंकवादी वार दातों को अंजाम देने का आर ोप है । हालांकि इंडियन मुजाहिदीन से जुडÞने वाली कडिÞयों की छानबीन कर  र हे दिल्ली पुलिस के अधिकारि यों ने दोनों से बर ामद चीजों के बार े में बताने से इनकार  कर  दिया, लेकिन सूत्रों से मिली जानकार ी के मुताबिक अजमल के कब्जे से ६३५ डाँलर , पांच भार तीय और  और  ६ नेपाली सिम कार्ड तथा तीन मोबाइल फोन बर ामद हुए हैं ।
पुलिस का यह भी कहना है कि आतंकवादी हमलों की झडी लगाने के बाद अजमल मधुबनी के पास नेपाली सीमावर्ती गांव में सुस् ता र हा था । उसने किर ाए पर  कमर ा इस वजह से लिया था जिससे उसके परि वार  को पता न चल सके कि वह क्या कर  र हा है । बुलाए जाने पर  गयूर  तो पुलिस के पास चला गया, मगर  अजमल ने पिंड छुडÞाने के लिए तमाम चालें चलीं । एक आला पुलिस अधिकार ी के मुताबिक, ‘उसने कहा कि वह जयपुर  का र हने वाला भार तीय है, लेकिन दिल्ली पुलिस के पास उसके खिलाफ सबूत थे ।’
पूर े आँपर ेशन को दिल्ली पुलिस ने अंजाम दिया और  बिहार  पुलिस की भूमिका सिर्फछापेमार ी के दौर ान उसकी मदद कर ने की र ही । बिहार  के एक वरि ष्ठ आइपीएस अधिकार ी का कहना है कि वे यह नहीं समझ सके कि दिल्ली पुलिस ने अजमल के भार तीय ससुर ाल वालों से पूछताछ न कर ने का फैसला क्यों किया । नेपाली सीमावर्ती मधुबनी जिला आतंकवादियों का अड्डा क्यों बना – दर भंगा में एक वरि ष्ठ पुलिस अधिकार ी ने माना कि इस इलाके की पुलिस अपने काम के नाम पर  सोती र ही, खासतौर  पर  इस वजह से कि जिले के अंदर  आतंकवाद न के बर ाबर  है । वे कहते हैं, ‘नेपाल की खुली सीमा होने के कार ण यह छिपने के लिहाज से एकदम माकूल जगह है । आप पर  यहां किसी की नजर  काफी समय तक नहीं पडÞेगी ।’
जिले में आतंकवादियों से लिंक का एक और  पहलू है इस जिले का नेपाल के पास स् िथत होना । हालांकि नेपाल के साथ लगती बिहार  की ६२५ किमी लंबी सीमा ज्यादातर  खुली ही है, लेकिन इस जिले के पडÞोसी देश के साथ काफी समय से सांस् कृतिक संबंधों के कार ण यह सीमा पूर ी तर ह खुली है । एक वरि ष्ठ पुलिस अधिकार ी कहते हैं, ‘हिंदू और  मुस् िलम दोनों समुदायों के सीमा पार  वैवाहिक संबंध हैं । यहां तक कि संपत्ति भी साझी है ।’ इससे भी बदतर  यह है कि नेपाल से आने वालों की कोई जांच-पडÞताल नहीं होती । इससे सीमा पार  के आतंकवादियों को भार त में प्रवेश कर ने का एक आसान र ास् ता मिल जाता है । एक वरि ष्ठ आइपीएस अधिकार ी कहते हैं, ‘भार त, नेपाल से आने वाले पाकिस् तानियों के बार े में जानकार ी ले सकता है और  इस बात की अपने स् तर  पर  जांच कर  सकता है कि क्या उन में से कोई बिना जरूर ी कागजात के भार त में दाखिल हो र हा है । बिहार  और  नेपाल के अधिकारि यों के बीच सीमा पर  तालमेल के स् तर  में अभी काफी सुधार  की जरूर त है ।’
एक पाकिस् तानी नागरि क की हाल ही में हर्ुइ गिर फ्तार ी इसे पक्का कर ती है । ३० नवंबर  को मधुबनी अदालत परि सर  से नेपाल से अवैध ढंग से घुस आने के आर ोप में हमीद-उर -र हमान को गिर फ्तार  किया गया था । वह फर्जी पासपोर्ट के आधार  पर  पिछले साल भार त आने के आर ोपी अपने बेटे मुख्तार  से मिलने आया था । मुख्तार  न्यायिक हिर ासत में है । इंडियन मुजाहिदीन के कारि ंदों की गिर फ्तार ी से आतंकवाद विर ोधी कार्र वाई को बल मिला है । लेकिन आतंक की गुत्थी अभी भी अनसुलझी है । अगर  गयूर  चाहता तो फर ार  हो सकता था । उसके पिता और  सकर ी में होम्योपैथ मोहम्मद नसरुल्ला जमाल को एक हफ्ते से ज्यादा समय से पता था कि पुलिस उसके बेटे की तलाश में है ।
२४ नवंबर  को जमाल ने पडÞोसी के यहां से अपने बेटे को फोन कर के बताया कि पुलिस इंतजार  कर  र ही है । गयूर  खुद चल कर  पछिया टोला इलाके में अपने घर  के सामने खडÞी पुलिस की जीप में जाकर  बैठ गया । उसके माता-पिता जोर  देकर  कहते हैं कि दर भंगा के अहमदिया शेफिया मदर से से फाजिल की पढर्Þाई कर ने वाला गयूर  मधुबनी और  दर भंगा जिलों से कभी बाहर  निकला ही नहीं ।
उत्तर ी बिहार  में पुलिस की कार्र वाई के बाद कई सवालों के जवाब नहीं मिले हैं । मसलन, पुलिस ने गयूर  के घर  की तलाशी क्यों नहीं ली – गुत्थी खोलने में मिली कामयाबी एक स् तर  पर  दिलासा देती है । लेकिन इनसे यह तकलीफदेह सवाल भी पैदा होता है-नेपाल की खुली सीमा से कितने आतंकवादी भार तीय क्षेत्र में दाखिल हो चुके हैं -
